Terms of Service

1. Acceptance of Terms

By accessing or using the FlyListings website and aircraft marketplace (collectively, the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Platform.

2. Description of Service

FlyListings operates an aircraft marketplace and brokerage service. Through the Platform, aircraft owners may list their aircraft for sale, and prospective buyers may browse listings and submit inquiries. FlyListings acts as an intermediary broker, facilitating communication between buyers and sellers while providing brokerage services including marketing, buyer qualification, and transaction coordination.

FlyListings does not guarantee the sale of any aircraft. The Platform is provided on an “as is” and “as available” basis.

3. User Accounts

To list an aircraft or submit inquiries, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. FlyListings reserves the right to suspend or terminate accounts that contain inaccurate or misleading information.

4. Listing Aircraft

When listing an aircraft on the Platform, you represent and warrant that:

• You are the legal owner of the aircraft or have authority from the owner to list it for sale.
• All information provided about the aircraft is accurate and not misleading.
• You will not include personal contact information (phone numbers, email addresses, social media handles) in public listing fields, as all buyer communication is managed through FlyListings.
• All photos uploaded are of the actual aircraft and you have the right to use them.

Listings are subject to review and approval by FlyListings. We reserve the right to reject, modify, or remove any listing at our sole discretion.

5. Broker-Mediated Communication

All communication between buyers and sellers is facilitated through FlyListings. Direct contact between parties outside of the Platform is prohibited until authorized by FlyListings. Attempting to circumvent broker-mediated communication may result in account suspension and does not relieve either party of their obligations under these Terms or the Listing Agreement.

6. Fees and Payment

Listing an aircraft on the Platform is free. FlyListings charges a success fee only upon the successful closing of a sale. The applicable fee is determined by aircraft category:

• Piston aircraft: 6% of sale price
• Turboprop aircraft: 4% of sale price
• Jet aircraft: 3% of sale price (2% for sales above $5,000,000)

The success fee is due at closing and is the responsibility of the seller unless otherwise agreed in writing. Additional details are outlined in the Listing Agreement.

7. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
• Submit false, misleading, or fraudulent listing information.
• Attempt to contact sellers or buyers directly outside of the Platform's communication channels.
• Scrape, harvest, or collect data from the Platform without authorization.
• Interfere with the proper functioning of the Platform.
• Impersonate another person or entity.

8. Intellectual Property

The Platform and its original content, features, and functionality are owned by FlyListings and are protected by copyright, trademark, and other intellectual property laws. By uploading photos or content to the Platform, you grant FlyListings a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with the Platform and marketing of your listing.

9. Disclaimer of Warranties

FlyListings does not inspect, verify, or guarantee the condition, airworthiness, legal status, or value of any aircraft listed on the Platform. Buyers are solely responsible for conducting their own due diligence, including pre-purchase inspections, title searches, and any other investigations they deem necessary. FlyListings is not liable for any inaccuracies in listing information provided by sellers.

10. Limitation of Liability

To the maximum extent permitted by law, FlyListings shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform, including but not limited to damages related to aircraft transactions, lost profits, or data loss.

11. Indemnification

You agree to indemnify, defend, and hold harmless FlyListings, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Platform or violation of these Terms.

12. Modifications

FlyListings reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
